Re: AVTS 4.0.7 - Heading Font size changes on different ballots



The statutes listed are for printed ballots. There aren't any specs listed for electronic voting devices beyond a reference in 101.5609(8) that the Department of State shall adopt rules prescribing standards. The Florida Administrative Code makes no mention of any specs for electronic voting machines.The only reference to specs at all is that lever machines (mechanical voting machines) should "conform as nearly as practicable" to code.
 
I'll look it up but I believe the magnify option would be allowable under federal statutes (ADA).

Here is how the section of statute reads.  I will place it in the Florida certification file.

 

(5)  On each ballot stub the words, "Official Primary Ballot" and the party name, and on the caption the words, "Official Primary Ballot _____ Party," shall be in 18-point caps; the printed instruction to electors immediately preceding the offices and names of candidates shall be in 10-point type; the headings shall be in 12-point blackfaced caps; the offices, the group or district numbers, and the words, "Vote for One" shall be in 12-point upper and lower case blackfaced type; the names of candidates shall be in 10-point lightfaced caps; the lines on which are printed the candidates' names shall be at least 11/2 picas apart, and the box to the right of each candidate's name provided for the cross (X) in voting shall be 2 picas wide and 11/2 picas high.”

The applicable code sections defining header and candidate font sizes under Florida law are 101.141(5) for primary elections and 101.151(7) for general elections. Code sections pertaining to nonpartisan elections defer to general election specifications.

BS 4.0.9 and 4.1.1 will no longer try to fit races into a column by changing the font size.  I still want the statute section I asked for 8/28.

It is a point of contention with the State of Florida.  The State of Florida has to have this fixed before we can continue with the phase 2 testing.  When I spoke to Mike Lindsey this morning, he is unwilling to schedule the next step until this issue is resolved.  The Florida SOS says this is a requirement to be fixed.  I would like to get back with Mike for scheduling this afternoon.  Do you have an estimate as to when this will be ready.

 

I believe that everyone knows the importance of getting to the second phase of testing.

This creates an additional line of test and the final race in the column has the Header Font size decreased in order to fit.  The point of contention was that this should not automatically be made smaller, but should have forced this race to appear in the next column. 

 

This is by design -- we even do it with paper ballots.  The idea is that its better to squish a race a little than to waste all the ballot real estate in the rest of the column.  Back in the VTS days it used to be SOP to print out a ballot and then play with the font settings to fit races into columns.

 

If its a "point of contention", I we could make the amount we are willing to cram configurable.  That would probably be a good idea just in principle -- I have never been comfortable with the hard-coded cram factor even with paper.  Some folks will tolerate more cramming than others(1).

 

That said, what is the basis for the contention?  I have seen statutes that say that candidate fonts need to be the same size within a race so that candidates are given a fair shake, but never that races have to be the same font.  If this is a statute in Florida, please quote the section so we have it on record.
